What This Means (2024 FDD)
According to Chop5 Salad Kitchen's 2024 Franchise Disclosure Document, if a franchisee fails to correct a non-compliance issue after being notified, Chop5 Salad Kitchen may impose a noncompliance fee of up to $500 per occurrence.
Furthermore, Chop5 Salad Kitchen may impose an additional $500 fee every 48 hours if the same non-compliance issue remains unresolved after the initial fee is applied. This means that non-compliance can quickly become expensive for a Chop5 Salad Kitchen franchisee.
The FDD specifies that these noncompliance fees are collected in consideration of Chop5 Salad Kitchen refraining from exercising its contractual right to terminate the Franchise Agreement. In other words, these fees act as a deterrent and a form of compensation to Chop5 Salad Kitchen for the franchisee's failure to meet brand standards, while allowing the franchisee an opportunity to correct the issue without immediate termination of the agreement.
It is important for prospective Chop5 Salad Kitchen franchisees to understand and adhere to all standards and operating procedures outlined in the Franchise Agreement and Manual to avoid incurring these fees. Franchisees should also ensure they have sufficient resources and systems in place to promptly address any non-compliance issues that may arise.
