What This Means (2024 FDD)
According to the 2024 Chop5 Salad Kitchen Franchise Disclosure Document, Chop5 Salad Kitchen will prepare and make available to franchisees, upon request, an annual statement of fund operations. This statement will include details of deposits and disbursements related to the brand fund.
This means that as a Chop5 Salad Kitchen franchisee, you have the right to request and receive a yearly overview of how the brand fund is being managed. This provides transparency regarding where the money contributed to the fund is being spent.
However, the FDD also states that the fund is not a trust and Chop5 Salad Kitchen has no fiduciary obligations to franchisees in its administration of the fund. Chop5 Salad Kitchen also does not ensure that expenditures in a geographic area are proportionate to the fees paid by franchisees in that area, or that franchisees benefit directly or in proportion to their brand fund fees. This means that while you can see the overall deposits and disbursements, there's no guarantee that the funds will be spent in a way that directly benefits your specific location or region.
