You may not engage in any Prohibited Activities at any time: (i) that you are an officer, director, employee or independent contractor of Franchisee; or (ii) during the Restricted Period.
Notwithstanding the foregoing, you may have an interest in a Competing Business during the Restricted Period as long as the Competing Business is not located within the Restricted Territory.
If you engage in any Prohibited Activities during the Restricted Period (other than having an interest in a Competing Business permitted by this Section), your Restricted Period will be extended by the period of time during which you engaged in the Prohibited Activity.

What This Means (2024 FDD)
According to Chop5 Salad Kitchen's 2024 Franchise Disclosure Document, a franchisee may have an interest in a Competing Business during the Restricted Period under certain conditions. Specifically, this is allowed as long as the Competing Business is not located within the Restricted Territory.
The Restricted Period is defined as the one-year period after the termination or expiration of the Franchise Agreement, the date the agreement is assigned to another person without the franchisee's ownership, or the date the franchisee no longer holds ownership in the franchise entity or restaurant. The Restricted Territory is generally a 10-mile radius around the franchisee's restaurant and other Chop5 Salad Kitchen locations in the same state, but this may be reduced to a 5-mile radius if a court deems the 10-mile radius unenforceable.
However, if a franchisee engages in any other prohibited activities during the Restricted Period, the Restricted Period will be extended by the amount of time the franchisee was engaged in the prohibited activity. This extension does not waive any rights or remedies Chop5 Salad Kitchen has regarding the breach. It is important for potential franchisees to understand these restrictions and how they might impact their future business ventures after leaving the Chop5 Salad Kitchen system.
