The development fee paid pursuant to §5 shall be deemed to include and satisfy the initial franchise fee imposed under each Franchise Agreement you sign for a Restaurant identified in the Development Schedule. You have no right to construct or operate a Restaurant until the parties have signed the Franchise Agreement and all ancillary agreements for that Restaurant. You must develop, open and operate each Restaurant in compliance with the Franchise Agreement and the Manual.

What This Means (2024 FDD)
According to the 2024 Chop5 Salad Kitchen Franchise Disclosure Document, the development fee covers the initial franchise fee for each restaurant outlined in the Development Schedule. This means that when a franchisee signs a Development Agreement to open multiple Chop5 Salad Kitchen locations, the upfront development fee satisfies the initial franchise fee that would normally be required for each individual franchise agreement associated with those locations.
This is beneficial for the franchisee as it streamlines the payment process. Instead of paying a separate initial franchise fee for each location, the franchisee pays one development fee upfront, which covers all subsequent initial franchise fees for the restaurants listed in the Development Schedule. This can simplify the financial planning and management for multi-unit developers.
However, it's important to note that while the development fee covers the initial franchise fees, franchisees are still required to sign a separate Franchise Agreement for each restaurant they plan to open. These individual agreements will contain the specific terms and conditions for operating each Chop5 Salad Kitchen location, and the franchisee must adhere to these terms in addition to the Development Agreement. The royalty fee, however, will not exceed that imposed under the Initial Franchise Agreement.
