What This Means (2024 FDD)

According to the 2024 Chop5 Salad Kitchen Franchise Disclosure Document, the landlord must provide Chop5 Salad Kitchen with copies of all written default notices sent to the tenant (the franchisee). These notices must be sent via email to brianm@chop5.com and by registered mail to CHOP5 Franchise LLC, 6011 Brownsboro Park Blvd., Suite F, Louisville, Kentucky 40207, Attention: Brian Mills, President. Chop5 Salad Kitchen may change the notification email and address by sending written notice to the landlord.

This clause is part of an agreement between the landlord and Chop5 Salad Kitchen to protect the franchisor's interests under the Franchise Agreement. It ensures that Chop5 Salad Kitchen is informed of any defaults by the franchisee (tenant) regarding the lease agreement. This allows Chop5 Salad Kitchen to take necessary actions to protect their franchise rights and interests, such as providing support to the franchisee or, if necessary, taking over the operation of the restaurant.

For a prospective Chop5 Salad Kitchen franchisee, this means that the franchisor has taken steps to monitor the franchisee's compliance with the lease agreement. It also means that the landlord is obligated to keep Chop5 Salad Kitchen informed of any issues with the franchisee's lease, providing an additional layer of oversight. This arrangement benefits the franchisor by mitigating risks associated with the franchisee's lease obligations and ensuring the continued operation of the Chop5 Salad Kitchen restaurant.
