What This Means (2024 FDD)

According to Chocolate Bash's 2024 Franchise Disclosure Document, if the franchisee and Chocolate Bash cannot agree on a site, the franchisee will be unable to meet the deadline for developing and opening the franchise as stated in the franchise agreement. In this case, Chocolate Bash may agree to extend the deadline. If Chocolate Bash does not agree to extend the deadline, the franchisee will be in default, and Chocolate Bash may terminate the franchise agreement.

This stipulation in the FDD highlights the importance of site selection and the potential consequences of failing to secure an approved location within the initial timeframe. It places the onus on the franchisee to find a suitable site, while Chocolate Bash retains the right to approve or disapprove the proposed location. The 30-day approval timeline suggests a relatively quick turnaround, but disagreements can lead to delays and potential termination.

Prospective Chocolate Bash franchisees should carefully consider the site selection process and the potential for delays. It would be prudent to discuss site selection criteria and potential extension policies with Chocolate Bash representatives before signing the franchise agreement. Understanding the factors that could lead to disagreements and the likelihood of obtaining an extension is crucial for mitigating risks and ensuring a successful launch.
