Patents
We do not own rights in, or licenses to, patents that are material to the franchise. We do not have any pending patent applications.
Copyrights
All of our original works of authorship fixed in a tangible medium of expression are automatically protected under the U.S. Copyright Act, whether or not we have obtained registrations. This includes our Operating Manual as well as all other sales, training, management and other materials that we have created or will create. You may use these copyrighted materials during the term of the franchise, in a manner consistent with our ownership rights, solely for your franchised business.
We do not have any registered copyrights. There are no pending copyright applications for our copyrighted materials. There are no currently effective determinations of the U.S. Copyright Office (Library of Congress) or any court regarding any copyright.
There are no agreements currently in effect that limit our right to use or license the use of our copyrighted materials.
We have no obligation to protect any of our copyrights or to defend you against claims arising from your use of copyrighted items.

According to Chocolate Bash's 2024 Franchise Disclosure Document, Chocolate Bash does not own rights in, or licenses to, patents that are material to the franchise. Additionally, Chocolate Bash does not have any pending patent applications. This means a franchisee will not be licensing any patented technology or processes as part of their franchise agreement.
While Chocolate Bash does not have patents, it does rely on copyright protection for its original works. These copyrighted materials, which include the Operating Manual and other sales, training, and management materials, are protected under the U.S. Copyright Act. Franchisees are allowed to use these materials during the franchise term, as long as it aligns with Chocolate Bash's ownership rights and is solely for their franchised business.
Chocolate Bash also has a proprietary, confidential Operating Manual with guidelines, standards, and policies for operating the business. They claim proprietary rights to confidential information and trade secrets, including methods, plans, data, financial information, processes, vendor pricing, supply systems, marketing systems, formulas, techniques, designs, layouts, operating procedures, customer data, information, and know-how.
