What This Means (2024 FDD)
According to Chocolate Bash's 2024 Franchise Disclosure Document, franchisees are indeed solely responsible for all hiring decisions and conditions of employment. While Chocolate Bash provides support and guidance, the ultimate responsibility rests with the franchisee. Specifically, Chocolate Bash offers suggested staffing levels and guidelines for hiring employees, as well as operational instructions in the manual that can be used for training purposes.
This means that as a Chocolate Bash franchisee, you have the autonomy to make your own choices about who you hire and the terms of their employment. However, it also means you assume all the risks and liabilities associated with these decisions. You'll need to ensure compliance with all applicable labor laws and regulations.
While Chocolate Bash offers support in the form of suggested guidelines and training materials, the FDD makes it clear that they are not liable for your hiring decisions. This is a fairly standard arrangement in franchising, where franchisees are typically considered independent business owners responsible for their own operations, including staffing.
