Is the franchisee licensed to use the Chocolate Bash System?

According to Chocolate Bash's 2024 Franchise Disclosure Document, CB Franchising grants the franchisee the right to operate a Chocolate Bash business solely at the specified location. This right is granted for the entire term of the Franchise Agreement, meaning the franchisee is licensed to use the Chocolate Bash system.

The Chocolate Bash system includes methods, procedures, and standards for operating a Chocolate Bash business. It also includes plans, specifications, equipment, signage, trade dress, particular products and services, the brand's Marks, training programs, business knowledge, and marketing plans. The franchise agreement states that the parties desire that CB Franchising license the Marks and the System to Franchisee for Franchisee to develop and operate a Chocolate Bash business on the terms and conditions of this Agreement.

This license is subject to the terms and conditions outlined in the Franchise Agreement. The franchisee must develop, open, and operate the Chocolate Bash business at the agreed-upon location for the duration of the agreement. Franchisees must adhere to the System Standards, which include mandatory procedures, requirements, and standards determined by CB Franchising. These standards cover various aspects of the business, such as appearance, cleanliness, customer service, design, equipment, inventory, marketing, operating hours, presentation of Marks, product quality, reporting, safety, and technology.
