What This Means (2024 FDD)
According to Chocolate Bash's 2024 Franchise Disclosure Document, CB Franchising has the right to set minimum qualifications for different categories of employees working at a franchise location. However, the franchisee is ultimately responsible for all employment-related matters. This includes recruiting, hiring, training, scheduling, supervising, compensating, and terminating employees. The franchisee is also responsible for the actions of their personnel.
This means that while Chocolate Bash can establish minimum standards for certain positions, the franchisee retains control over the day-to-day management of their staff. The franchisee is the sole employer, and Chocolate Bash is not considered a joint employer. To ensure clarity, Chocolate Bash may require the franchisee and their employees to sign an acknowledgment form confirming that the franchisee is the employee's sole employer.
This arrangement is fairly typical in franchising, where the franchisor sets brand standards and the franchisee manages the local operation. The ability to set minimum qualifications allows Chocolate Bash to maintain a consistent level of service and expertise across all locations. However, the franchisee bears the responsibility and liability for their employees' actions, emphasizing the importance of careful hiring and training practices.
