Can CB Franchising require a Chocolate Bash franchisee to provide training programs to its employees?

According to Chocolate Bash's 2024 Franchise Disclosure Document, CB Franchising has the authority to mandate that franchisees provide training programs to their employees. This requirement is outlined in Section 7.6, which states that Chocolate Bash "may require Franchisee to provide training programs to its employees." This means that as a franchisee, you could be obligated to implement and conduct training programs for your staff as directed by the franchisor.

Furthermore, Chocolate Bash may set minimum qualifications for different categories of employees. However, the franchisee maintains sole responsibility for the terms and conditions of employment, including recruiting, hiring, scheduling, supervising, compensation, and termination of personnel. The franchisee is also responsible for all actions of its personnel.

In addition to requiring franchisee-led training, Chocolate Bash can also mandate that the Principal Executive or any other employees complete training programs, in any format and location determined by Chocolate Bash. The franchisee is responsible for covering all travel, living, and other expenses associated with these training programs if they are held at a location requiring travel. Chocolate Bash may also charge a reasonable fee for these training programs.
