What This Means (2024 FDD)

According to Chocolate Bash's 2024 Franchise Disclosure Document, Section 2.1 of the Franchise Agreement outlines the specific right granted to the franchisee. CB Franchising grants the franchisee the right to operate a Chocolate Bash business, but only at a specific location. The agreement emphasizes the importance of the location, stating that if the location isn't specified on the Summary Page of the agreement, it will be determined according to Section 6.1.

This means a prospective franchisee's rights are tied to a physical location. The franchisee is obligated to develop, open, and operate the Chocolate Bash business at the agreed-upon location for the entire term of the Franchise Agreement. This underscores the importance of carefully selecting and agreeing upon the location, as it is a fundamental aspect of the franchise rights being granted.

This location-specific grant is typical in the franchise industry, as it allows the franchisor to manage brand distribution and market saturation. However, it also places a significant responsibility on the franchisee to ensure the chosen location is viable for the long term. A franchisee should carefully review Section 6.1 and any related documents to fully understand how the location is determined and what recourse they may have if the location proves unsuitable after signing the agreement.
