What This Means (2025 FDD)

According to Chicken Guy's 2025 Franchise Disclosure Document, Chicken Guy has the right to waive, defer, or permit variations from system standards for a franchisee or prospective franchisee. This decision is based on the peculiarities of a particular site, existing building configuration or circumstance, density of population, business potential, trade area population, or any other condition or circumstance. However, Chicken Guy also retains the right to deny any such request if it believes it would not be in the best interests of the Chicken Guy system.

This clause provides Chicken Guy with flexibility in adapting the franchise model to different locations and situations. For a prospective franchisee, this could mean that certain requirements might be adjusted to suit the specific characteristics of their chosen site, potentially reducing initial investment costs or operational challenges. However, it's important to note that any variations are at Chicken Guy's discretion, and there's no guarantee that a waiver will be granted.

It is also important to note that Chicken Guy makes no warranties or guarantees upon which a franchisee may rely by providing any waiver, approval, consent or suggestion to Franchisee in connection with the Franchise Agreement, and assumes no liability or obligation to Franchisee therefor, or by reason of any neglect, delay, or denial of any request therefor. This means that Chicken Guy is not liable if a waiver or approval does not result in the franchisee's desired outcome.

Prospective franchisees should carefully consider this clause and discuss with Chicken Guy any specific site-related challenges they anticipate. Understanding the conditions under which waivers might be granted or denied is crucial for making informed decisions about site selection and investment.
