What This Means (2025 FDD)
According to Chicken Guy's 2025 Franchise Disclosure Document, Chicken Guy does not assume liability or responsibility for several aspects of the Authorized Site. Specifically, Chicken Guy is not responsible for evaluating the soil for hazardous substances, inspecting any structure for asbestos or other toxic materials, ensuring compliance with the Americans with Disabilities Act (ADA), or ensuring compliance with any other applicable law.
This means that the responsibility for these critical evaluations and compliance measures falls solely on the Developer, which is the franchisee. It is the franchisee's duty to obtain satisfactory evidence and assurances that the site is free from environmental contamination and complies with ADA requirements. This places a significant burden on the franchisee to conduct thorough due diligence before developing the site.
This allocation of responsibility is fairly common in franchising, where franchisees often bear the responsibility for site-specific compliance issues. However, prospective Chicken Guy franchisees should carefully consider the potential costs and liabilities associated with these responsibilities. They should engage qualified professionals to conduct the necessary evaluations and ensure compliance with all applicable regulations before committing to a specific site. This will help mitigate potential risks and ensure the long-term viability of their Chicken Guy restaurant.
