For publicly-held entities as of the date of the first franchise-related agreement between the Developer and Chicken Guy, these requirements apply only to the Developer's Continuity Group. The Continuity Group refers to individuals whom Chicken Guy and the Developer have designated; any changes within this group must be documented with addenda to the Data Sheet. The Continuity Group must maintain at least 51% ownership of the voting securities if the Developer is a corporation, at least 51% of the membership interests if a limited liability company, or at least a 51% interest in the operating profits and losses if a partnership.

Furthermore, if any party with an interest in the Development Agreement receives a legitimate offer from a third party or intends to undertake any transfer requiring Chicken Guy's approval, they must notify Chicken Guy in writing. This notification should include the terms of the proposed transfer and any related information or documentation that Chicken Guy may reasonably require. Chicken Guy has the option to purchase the interest under the same financial terms offered by the third party, excluding any finder's or broker's fees. Chicken Guy must exercise this right of first refusal within 30 days of receiving the written notification.
