What is the Developer obligated to conform to when developing Franchised Restaurants for Chicken Guy?

Developer understands and acknowledges the importance of Chicken Guy's high and uniform standards of quality, operations and service and the necessity of developing Franchised Restaurants in strict conformity with this Agreement and the Chicken Guy! Operations Manual ("Manual").
Chicken Guy is willing to grant Developer the opportunity to develop Franchised Restaurants in a certain geographic territory, subject to the terms and conditions of this Agreement.
NOW THEREFORE, in consideration of Chicken Guy's grant to Developer of the right to develop Franchised Restaurants in the Development Territory during the term of this Agreement ("Development Term"), as well as the mutual covenants, agreements and obligations set forth below, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows:

What This Means (2025 FDD)
According to the 2025 Chicken Guy Franchise Disclosure Document, a developer must develop Franchised Restaurants in strict conformity with the Development Agreement and the Chicken Guy Operations Manual. The developer is granted the right to develop Franchised Restaurants within a specific geographic area, known as the Development Territory, during the Development Term, which begins when the agreement is signed by Chicken Guy and ends when the lease is signed or the site is purchased for the last restaurant required by the Development Schedule.
Strict compliance with the Development Schedule is essential, and failure to meet deadlines for development, opening restaurants, or obtaining site approval constitutes a material breach of the agreement, potentially leading to immediate termination by Chicken Guy. The developer must also get Chicken Guy's written approval for each site and submit a Real Estate Site Application with information Chicken Guy requires, such as demographic characteristics, traffic patterns, parking, competition, proximity to other businesses, and the site's physical characteristics.
Furthermore, the developer needs to develop and submit a Business Plan outlining actions to ensure compliance with the Development Schedule and the operation and management of restaurants according to Chicken Guy's standards. This plan must be revised as required by Chicken Guy and implemented as approved. The developer is also responsible for securing insurance necessary for liabilities related to the development and operation of each restaurant, meeting minimum insurance requirements specified by Chicken Guy.
