What is the condition for signing the Franchise Agreement and the Nontraditional Location Addendum for a Chicken Guy Nontraditional Restaurant?

If you buy a franchise to develop and operate a Nontraditional Restaurant, after we have approved the site, you will sign a Franchise Agreement (Exhibit E) and an Addendum to Franchise Agreement for a Nontraditional Location ("Nontraditional Location Addendum") (Exhibit F) and pay the Initial Franchise Fee. The Nontraditional Location Addendum will identify the larger building ("Facility") in which the Nontraditional Restaurant will be located. The Nontraditional Location Addendum also will identify the portion of the Facility in which the Nontraditional Restaurant will be located. All references in this disclosure document to "Nontraditional Restaurant" or "Nontraditional Location" refer only to your operation of that portion of the Facility that is occupied by the Chicken Guy! Restaurant. Unless otherwise noted, in this disclosure document, all references to a "Franchised Restaurant" or "Franchised Location" also will include a Nontraditional Restaurant or Nontraditional Location, respectively.

What This Means (2025 FDD)
According to Chicken Guy's 2025 Franchise Disclosure Document, a franchisee must have an approved site to sign the Franchise Agreement and Nontraditional Location Addendum for a Nontraditional Restaurant. After Chicken Guy approves the site for a Nontraditional Restaurant, the franchisee will then sign the Franchise Agreement and the Nontraditional Location Addendum. The franchisee must also pay the Initial Franchise Fee at this time.
The Nontraditional Location Addendum serves to identify the larger building or "Facility" where the Nontraditional Restaurant will operate. It also specifies the exact portion of that Facility that the Chicken Guy restaurant will occupy. This distinction is important because all references to "Nontraditional Restaurant" or "Nontraditional Location" in the FDD pertain specifically to the operation within that defined portion of the larger Facility.
It is important to note that all references to a "Franchised Restaurant" or "Franchised Location" also include a Nontraditional Restaurant or Nontraditional Location, respectively, unless otherwise specified in the FDD. This means that the terms and conditions outlined for standard Chicken Guy franchises generally apply to Nontraditional locations as well, providing a consistent framework for both types of operations.
