What This Means (2025 FDD)
According to Chick Fil A's 2025 Franchise Disclosure Document, the Food Truck is to be used as an extension of the Business to produce, hold, sell, and distribute certain products to customers from the Food Truck at approved Sales Locations. This use is defined as the "Licensed Use" and is subject to the terms and conditions outlined in the agreement and the Franchise Agreement, including the limited License and the Food Truck License Summary. The Operator is explicitly restricted from using the Food Truck for any purpose other than the Licensed Use.
Chick Fil A also retains the right to utilize the Food Truck for an "Alternate Use" at any time, for any reason, or for no reason. This includes using the Food Truck for food or other product distribution during events such as natural disasters, weather events, pandemics, or epidemics. If Chick Fil A elects to use the Food Truck for an Alternate Use, the Operator's obligations under the agreement, including the sublease, will be suspended. The Operator's sole remedy in such a case is the return of the Food Truck after the Alternate Use for the remainder of the term, without any right to an extension. Chick Fil A assumes no liability if the Food Truck is not furnished or made available to the Operator.
The Operator's use of the Food Truck is also governed by a Food Truck Lease, and the Operator must comply with all applicable laws, rules, and regulations, as well as the terms of the lease. The Operator cannot enter into any agreements that allow other parties rights concerning the Food Truck without Chick Fil A's prior written approval. Additionally, the Operator is responsible for storing and maintaining the Food Truck at their Business location when it is not in use at a Sales Location, and for servicing and repairing the Food Truck to maintain its appearance and good working condition, using reputable vendors and following Chick Fil A's standards and guidelines.
