According to Chick Fil A's 2025 Franchise Disclosure Document, the case Pittman and Ukpere v. Chick-fil-A, Inc., also known as the Pittman Action, was dismissed on May 3, 2024. The case, filed on September 28, 2021, in the United States District Court for the Southern District of New York, was later appealed to the Second Circuit. The initial complaint was amended on December 13, 2021, before its dismissal.
The Pittman Action was one of several putative class actions against Chick Fil A related to delivery orders made through the Chick-fil-A App or website between November 1, 2019, and April 30, 2021. The plaintiffs in these cases claimed that Chick Fil A misrepresented delivery costs by charging a delivery fee without disclosing that menu prices were higher for delivery than in-store purchases. Chick Fil A denied any liability in these cases.
The Pittman Action, along with other similar cases, was consolidated with the Mayheu Action for settlement purposes on September 29, 2023. The plaintiffs in the consolidated complaint asserted various claims, including negligent misrepresentation and violations of consumer fraud acts and unfair competition laws in multiple states. All plaintiffs sought actual and statutory damages and declaratory judgments.
