What This Means (2024 FDD)

According to Chem Dry's 2024 Franchise Disclosure Document, the requirements of paragraph 6 of the Equipment Sales and Security Agreement are waived if the equipment purchased is not proprietary to CDI (Chem-Dry, Inc.) and does not bear any insignia or color schemes associated with the Chem-Dry brand. This waiver is specifically tied to the nature of the equipment itself.

This means that if a Chem Dry franchisee purchases equipment that is generic and not branded with Chem Dry's trademarks or color schemes, the restrictions outlined in paragraph 6 of the Equipment Sales and Security Agreement do not apply to that specific equipment. Paragraph 6 likely contains requirements about the use, maintenance, or disposal of Chem Dry's proprietary equipment, which Chem Dry deems unnecessary to enforce on equipment that doesn't carry its branding.

For a prospective Chem Dry franchisee, this could offer some flexibility in sourcing certain types of equipment, potentially reducing costs or allowing for customization. However, it's crucial to understand exactly what paragraph 6 entails to fully grasp the implications of this waiver. Franchisees should clarify with Chem Dry what specific equipment falls under this waiver and what the requirements of paragraph 6 are to make informed purchasing decisions.
