Are there any restrictions on where a Chem-Dry franchisee can operate, solicit, and advertise?

According to Chem-Dry's 2024 Franchise Disclosure Document, a franchisee's ability to operate, solicit, and advertise is restricted to their assigned Franchised Area, with exceptions for certain commercial jobs. Chem-Dry does not offer exclusive territories, meaning franchisees may face competition from other franchisees, company-owned outlets, or other distribution channels. The number of Chem-Dry franchises allowed in a Franchised Area is determined by dividing the area's population by 60,000. The resulting number is the maximum number of franchises Chem-Dry may grant in that area.

Chem-Dry franchisees must operate their business from a single location within their Franchised Area, but they can relocate anywhere within that area with 10 days' prior written notice to Chem-Dry. The business office must be capable of receiving and storing shipments. Chem-Dry, its affiliates, and their franchisees may offer similar goods and services both inside and outside a franchisee's Franchised Area without compensating the franchisee. There are no restrictions on competition or customer solicitation among Chem-Dry's affiliated brand systems.

Chem-Dry franchisees are required to list their business in telephone directories distributed within their Franchised Area, and in specified internet directory categories. Chem-Dry may update this obligation to digital and electronic advertising. Franchisees must not offer or sell any type of service or product that is not authorized by Chem-Dry. They also cannot resell cleaning solutions without express written approval from Chem-Dry. The equipment used in Chem-Dry businesses can only be used for the operation of the Chem-Dry Business in compliance with the Franchise Agreement.
