What This Means (2024 FDD)
According to Chem-Dry's 2024 Franchise Disclosure Document, a franchisee faces significant restrictions on advertising, soliciting, accepting, or performing services outside of their designated Franchised Area. Specifically, Chem-Dry prohibits franchisees from advertising or soliciting business beyond their assigned territory. This means all marketing efforts must be confined within the boundaries of the Franchised Area to avoid potential penalties.
If a Chem-Dry franchisee violates these territorial restrictions by accepting or performing a job outside their Franchised Area, Chem-Dry has the right to impose a fine of $5,000 per violation or even terminate the Franchise Agreement. This underscores the importance of adhering strictly to the geographic limitations set forth in the agreement. While franchisees can utilize channels like the Internet, catalog sales, or telemarketing, these methods must still target only customers within their Franchised Area.
Furthermore, all marketing activities, including online marketing, must comply with Chem-Dry's Advertising Rules & Guidelines. Failure to adhere to these guidelines can result in a fine of $2,000 per violation. This highlights the need for franchisees to stay informed about and compliant with Chem-Dry's advertising standards to avoid financial penalties. Chem-Dry and its affiliates also reserve the right to solicit and make sales within a franchisee's territory without providing compensation to the franchisee, which is a common practice in franchising to allow the franchisor to pursue national accounts or online sales.
In summary, Chem-Dry franchisees must be vigilant about restricting their advertising and services to their assigned Franchised Area to avoid substantial fines or potential termination of their franchise agreement. Compliance with Chem-Dry's advertising guidelines is also essential to prevent additional financial penalties.
