What This Means (2024 FDD)
Based on the 2024 Chem Dry Franchise Agreement, the document does not explicitly state that a franchisee has the right to offer or sell subfranchises. The agreement outlines that Chem Dry grants a non-exclusive franchise to the franchisee to operate a Chem-Dry business within a defined area. The franchisee is authorized to offer and perform specific services such as carpet and area rug cleaning, upholstery cleaning, spot removal, and applying anti-allergen and deodorizer, as mandated by Chem Dry.
The agreement emphasizes that the franchisee must operate and conduct business from a single location within their assigned territory, and they can operate multiple crews and vans as needed. Franchisees are expected to advertise and solicit business only within their franchised area and are penalized if they perform jobs outside of it. Chem Dry retains all rights regarding the franchise system and the sale of related products and services, including the right to grant franchises in any area it deems appropriate.
Given the absence of any explicit mention of subfranchising rights and Chem Dry's reservation of rights regarding the franchise system, it can be inferred that franchisees do not have the right to offer or sell subfranchises. A prospective franchisee should seek clarification from Chem Dry directly regarding subfranchising opportunities to fully understand the scope and limitations of their franchise agreement.
