What This Means (2024 FDD)

According to Chem Dry's 2024 Franchise Disclosure Document, Chem Dry will not be held liable for certain events that are beyond its reasonable control. Specifically, Chem Dry is not liable for any interruption of business, access delays or access interruptions to the Chem Dry site or websites accessed through Chem Dry's service, content non-delivery, mis-delivery, corruption, destruction, or other modification.

This limitation of liability means that if a Chem Dry franchisee experiences any of these issues due to circumstances outside of Chem Dry's control, the franchisee will not be able to seek damages from Chem Dry. These types of limitations are relatively standard in franchise agreements, as franchisors cannot be expected to guarantee uninterrupted service or be responsible for events they cannot reasonably prevent.

It is important for a prospective Chem Dry franchisee to understand these limitations and to consider how they might impact their business. For example, if a franchisee's business is significantly impacted by an internet outage or a data breach that is beyond Chem Dry's control, the franchisee will need to have their own contingency plans in place, as they will not be able to rely on Chem Dry for compensation.
