Who determines the resolution to a customer complaint when CDI becomes involved for a Chem Dry franchise?
Chem_Dry Franchise · 2024 FDDAnswer from 2024 FDD Document
FRANCHISEE acknowledges that CDI's affiliates and their franchisees not using the Marks may offer and sell goods and services similar to goods and services offered and sold by Chem-Dry Businesses inside and outside the Franchised Area, and to customers or businesses located in the Franchised Area. Nothing in this Agreement or otherwise shall prevent these CDI affiliates or their franchisees from offering their goods and services, without compensation to FRANCHISEE, inside the Franchised Area. In the event of a conflict between FRANCHISEE and an CDI affiliate outlet, CDI agrees to use reasonable methods to address the issue, however FRANCHISEE acknowledges and agrees that CDI and its affiliates have not established, and have no obligation to establish, any method of resolving conflicts between any competing franchises regarding territory, customers and franchisor support. Further, there are no restrictions or restraints on competition or customer solicitation among the CDI affiliated brand systems that may offer similar products and services.

What This Means (2024 FDD)
According to Chem Dry's 2024 Franchise Disclosure Document, if a conflict arises between a franchisee and a Chem Dry affiliate outlet, Chem Dry agrees to use reasonable methods to address the issue. However, the franchisee acknowledges that Chem Dry and its affiliates have not established, and have no obligation to establish, any method of resolving conflicts between any competing franchises regarding territory, customers, and franchisor support. This indicates that while Chem Dry will attempt to address conflicts, the resolution is not guaranteed and there is no formal method in place.
This lack of a formal conflict resolution process could pose a risk for franchisees. Without a clearly defined procedure, the outcome of a dispute may be uncertain and potentially depend on Chem Dry's discretion. This could lead to inconsistent resolutions and potentially disadvantage some franchisees over others. It is also important to note that there are no restrictions on competition or customer solicitation among the CDI affiliated brand systems that may offer similar products and services.
Prospective franchisees should carefully consider this aspect and inquire with Chem Dry about the types of 'reasonable methods' they employ to resolve conflicts. Understanding the typical steps taken and the factors considered in resolving disputes can help a franchisee better assess the potential risks and benefits of investing in a Chem Dry franchise. Additionally, franchisees should seek clarification on how Chem Dry balances the interests of its franchisees with those of its affiliate outlets when conflicts arise.
