9.06 Personnel.The Franchised Restaurant must at all times be under the direct, on-premises supervision of an Operator who has completed our training program to our satisfaction and staffed by a sufficient number of competent and properly trained employees. You (or your Operating Partner) at all times must remain active in overseeing the operations of the Franchised Restaurant. If the relationship with your Operating Partner terminates, you must promptly hire a successor Operating Partner. Any successor Operating Partner must meet our approval and must successfully complete our training program. You are solely responsible for all employment decisions for the Franchised Restaurant, including hiring, firing, remuneration, personnel policies, training, benefits, and maintaining supervision and discipline, regardless of whether you received advice from us on any of these subjects. You may not recruit or hire any person who is a management level employee of ours or of any Restaurant operated by us, our Affiliates or another franchisee of ours without obtaining the employer's consent, which consent may be withheld for any reason or no reason.

What This Means (2025 FDD)
According to Checkersrallys's 2025 Franchise Disclosure Document, the franchised restaurant must be under the direct, on-premises supervision of an Operator who has completed Checkersrallys's training program to their satisfaction. Additionally, the restaurant must be staffed by a sufficient number of competent and properly trained employees. The franchisee (or their Operating Partner) must remain active in overseeing the operations of the franchised restaurant.
If the relationship with the Operating Partner terminates, the franchisee must promptly hire a successor Operating Partner who meets Checkersrallys's approval and successfully completes their training program. The franchisee is solely responsible for all employment decisions, including hiring, firing, remuneration, personnel policies, training, benefits, and maintaining supervision and discipline, regardless of any advice received from Checkersrallys.
Furthermore, the franchisee is prohibited from recruiting or hiring any management-level employee of Checkersrallys or any restaurant operated by Checkersrallys, its affiliates, or another franchisee without obtaining the employer's consent. This consent can be withheld for any reason. This ensures that Checkersrallys and its franchisees maintain control over their personnel and prevents the poaching of valuable employees within the system.
