You represent to our satisfaction, and in connection with signing this Addendum have provided us (or agree to provide promptly upon our request) relevant supporting documentation, that: (a) you are a current franchisee in good standing with us, including being in full compliance with all currently effective agreements with us or our affiliates; and (b) you will develop the Franchised Restaurant in accordance with our current prescribed plans, specifications and design model for Restaurants (including, without limitation, any modifications or adjustments we authorize and timely introduce for similarly-situated Restaurants, or otherwise incorporate into the System for all franchisees, before you open the Franchised Restaurant).

What This Means (2025 FDD)
According to Checkersrallys's 2025 Franchise Disclosure Document, specifically within the addendum to the franchise agreement, a franchisee must develop the franchised restaurant in accordance with Checkersrallys's current prescribed plans, specifications, and design model for restaurants. This includes any modifications or adjustments Checkersrallys authorizes and introduces for similarly-situated restaurants, or otherwise incorporates into the system for all franchisees, before the franchisee opens their Checkersrallys restaurant.
Checkersrallys will furnish prototype plans for a restaurant, possibly for a fee, to be used as a guideline for developing the final construction plans. Franchisees can modify these plans to comply with applicable laws, codes, regulations, ordinances, building codes, permit requirements, and lease restrictions. However, franchisees need specific authorization from Checkersrallys to modify the dimensions or exterior design of the building. All modified plans and specifications must be submitted to Checkersrallys for approval before seeking municipal approval.
The franchisee is responsible for ensuring compliance with all federal, state, and local laws and regulations, including the ADA. Checkersrallys's review and approval of the plans do not constitute an assessment of compliance with these laws. Franchisees must also submit revised or "as built" plans and specifications to Checkersrallys upon request. All development must adhere to the approved plans and specifications and comply with all applicable laws, ordinances, and local rules and regulations.
Any architect, general contractor, or other builders used by the franchisee must be licensed and maintain appropriate insurance. Checkersrallys's approval of these professionals does not represent a warranty of their qualifications or competence but indicates that they meet Checkersrallys's acceptable criteria. Checkersrallys may provide guidance during the premises' development and periodically inspect the premises. However, Checkersrallys does not assume liability or responsibility to the franchisee or third parties through these approvals and inspections, which are solely for ensuring compliance with Checkersrallys's standards.
