As a Checkersrallys franchisee, what must I conspicuously identify myself as in all dealings?
Checkersrallys Franchise · 2025 FDDAnswer from 2025 FDD Document
Nothing contained in this Agreement, or arising from the conduct of the parties hereunder, is intended to make either party a general or special agent, joint venturer, partner or employee of the other for any purpose whatsoever. You must conspicuously identify yourself in all dealings with customers, lessors, contractors, suppliers, public officials, personnel and others as the owner of development rights granted hereunder and must place such other notices of independent ownership on such forms, business cards, stationery, advertising and other materials as we require at any time and from time to time.

What This Means (2025 FDD)
According to Checkersrallys's 2025 Franchise Disclosure Document, as a franchisee, you must conspicuously identify yourself as the owner of the development rights granted to you in all dealings with customers, lessors, contractors, suppliers, public officials, personnel, and others. This means you need to make it clear that you are an independent owner and operator of your Checkersrallys franchise.
This identification must also be placed on forms, business cards, stationery, advertising, and other materials as required by Checkersrallys from time to time. The purpose of this requirement is to ensure that all parties understand that you are an independent business owner and not an employee or agent of Checkersrallys itself. This distinction is important for legal and liability reasons.
By clearly identifying yourself as an independent owner, you help to avoid any potential confusion or misrepresentation about the relationship between your business and the Checkersrallys brand. This transparency is a standard practice in franchising, protecting both the franchisee and the franchisor by clarifying the independent nature of the franchise operation.
