What This Means (2025 FDD)
According to the 2025 Checkersrallys FDD, a franchisee is explicitly restricted from using the franchised restaurant for any purpose other than operating a Checkersrallys restaurant in compliance with the Franchise Agreement. This restriction is in place to ensure brand consistency and adherence to the Checkersrallys system.
This means a Checkersrallys franchisee cannot use the restaurant premises for any other business ventures or activities, even if they seem related or complementary. For example, a franchisee cannot operate a catering service or delivery business from the restaurant without prior consent from Checkersrallys. The franchisee is also restricted to conducting business only with customers at the franchised restaurant, reinforcing the primary purpose of the location.
This restriction is a standard practice in franchising, as franchisors like Checkersrallys need to maintain uniformity and control over their brand and operations. Any deviation from the approved use could potentially harm the brand's reputation or create inconsistencies in the customer experience. Franchisees need to be aware of this limitation and ensure they adhere strictly to the terms of the Franchise Agreement to avoid any breach of contract.
Furthermore, Checkersrallys retains the right to change the types of authorized goods and services offered at the restaurant. This provision allows Checkersrallys to adapt to market trends and consumer preferences, but it also means that franchisees must be prepared to adjust their operations as directed by the franchisor. Franchisees are also required to maintain sufficient inventory of approved products to meet Checkersrallys' standards.
