What factors may Checkersrallys consider when deciding whether to accept or reject a proposed site?

According to Checkersrallys's 2025 Franchise Disclosure Document, when deciding whether to accept or reject a proposed site, Checkersrallys may consider factors they deem appropriate. These factors include the general location and neighborhood, demographic information, traffic patterns, access, visibility, and the location of other restaurants and food establishments, including other Checkersrallys locations. Checkersrallys also considers the size, condition, configuration, appearance, and other physical characteristics of the site.

Checkersrallys will furnish franchisees with their standard site selection criteria for Restaurants, which they may establish and modify from time to time. Franchisees must submit a complete application for a franchise and a site application form for each proposed site, believing it conforms to Checkersrallys' then-current standard site selection criteria. The site application should include a description of the proposed site, a summary of traffic patterns, parking, the character of the neighborhood, competition, proximity to other businesses, and a letter of intent or other evidence confirming favorable prospects for obtaining the proposed site.

Checkersrallys will make a site acceptance decision within 30 days after acknowledging receipt of the complete site report and any other requested materials. The franchise agreement states that Checkersrallys's suggestion, approval, or provision of information regarding a site does not constitute a representation or warranty of any kind regarding the site's suitability for a Restaurant or any other purpose. The franchisee's decision to develop and operate a Restaurant at any site is based solely on their own independent investigation of the site's suitability.
