What This Means (2025 FDD)
According to Checkersrallys's 2025 Franchise Disclosure Document, the addendum contains the entire understanding and agreement between Checkersrallys and the franchisee regarding the addendum's subject matter. It also supersedes all prior written or oral agreements. The addendum includes a clause that states it may not be altered, amended, or modified unless both parties agree to the changes in writing and properly execute the revised document.
This clause is a standard provision in franchise agreements and addenda. It ensures that all modifications are formally documented and agreed upon, preventing disputes based on informal or unwritten understandings. The requirement for a written agreement, properly executed, provides a clear and legally binding record of any changes to the original terms.
For a prospective Checkersrallys franchisee, this means that any desired changes to the addendum must be negotiated and formalized in writing. Verbal agreements or informal understandings will not be enforceable. This protects both the franchisee and Checkersrallys by ensuring clarity and accountability in their contractual relationship.
