What This Means (2025 FDD)

According to Checkers' 2025 Franchise Disclosure Document, the landlord must furnish Checkers, at Checkers' request, a copy of any sales or operating information for the premises provided by the tenant. This requirement is part of an agreement where the landlord includes specific terms in the lease to protect Checkers' rights as the franchisor.

This provision ensures that Checkers has access to important operational data related to the franchise location. By obtaining sales and operating information directly from the landlord, Checkers can verify the accuracy of reports provided by the franchisee and gain insights into the performance of the location. This can help Checkers monitor the financial health of the franchise and identify any potential issues.

For a prospective Checkers franchisee, this clause means that the franchisor has an additional layer of oversight to ensure compliance and performance. While the franchisee is responsible for providing regular reports to Checkers, the franchisor also has the right to request supporting data from the landlord, creating a system of checks and balances. This arrangement could help to ensure transparency and accountability in the operation of the franchise.

It is important for franchisees to understand that Checkers has the right to request this information from the landlord. Franchisees should maintain accurate records and be prepared to provide necessary documentation to both Checkers and the landlord to avoid any discrepancies or issues. This clause underscores the importance of a collaborative relationship between the franchisee, franchisor, and landlord to ensure the success and compliance of the Checkers franchise.
