If you sign a Franchise Agreement to acquire a Checkers franchise or Rally's franchise, then you will have the right to establish and operate your Checkers Restaurant or Rally's Restaurant (each referred to as the "Franchised Restaurant") at the location we approve (the "Premises").

According to Checkers' 2025 Franchise Disclosure Document, the "Premises" refers to the location that Checkers approves for a franchisee to establish and operate their Checkers or Rally's restaurant. This location is agreed upon under the standard form franchise agreement.

Checkers also allows for restaurants to be located at "Non-Traditional Sites," which are locations that independently generate customer traffic flow separate from the general customer traffic flow of the surrounding area, or by their nature are not tied to a particular physical location. Examples of Non-Traditional Sites include military bases, big-box retail outlets like Walmart, transportation venues such as airports and train stations, sports and entertainment venues, industrial or office complexes, hotels, educational facilities, casinos, hospitals, governmental institutions, amusement parks, grocery stores, mobile food trucks, and co-branding locations.

In high-density markets, Checkers franchisees may also develop in-line restaurants without drive-thru lanes or restaurants at Non-Traditional Sites. These restaurants are estimated to be 700 to 3,500 square feet with an interior dining area. However, the distinctive Checkers trade dress must be incorporated to the maximum level allowed by local government.
