"Premises" – The location for operation of the Franchised Restaurant selected by Franchisee and approved in writing by Franchisor, as identified in Exhibit B
"Restaurants" – [INSERT BRAND: Checkers/Rally's] restaurants we or any of our Affiliates own, operate or franchise that use the Marks and System.
"System" – The business methods, designs and arrangements for developing and operating Restaurants, which include the Marks, building designs and layouts, equipment, ingredients, recipes, methods of preparation and specifications for authorized food products, methods of inventory control and certain operating and business standards and policies, all of which we may improve, further develop or otherwise modify at any time and from time to time.

What This Means (2025 FDD)
According to Checkers' 2025 Franchise Disclosure Document, the "System" includes business methods, designs, and arrangements for operating Restaurants, encompassing the Marks, building designs, layouts, equipment, ingredients, recipes, preparation methods, and specifications for authorized food products. Checkers retains the right to improve, further develop, or modify the System at any time.
As a Checkers franchisee, you are obligated to use the System, including the specified ingredients and recipes, solely in connection with operating the Restaurant at the approved Premises. You are not allowed to conduct the business or use the System at any other site without prior consent from Checkers. The Franchised Restaurant can only be used for operating a Restaurant in compliance with the Franchise Agreement.
This means a franchisee must adhere strictly to Checkers' prescribed methods and standards in all aspects of restaurant operation, particularly in food preparation. Deviation from approved ingredients and recipes is not permitted, ensuring brand consistency and quality control across all Checkers locations.
