If you have suggested a location for the Franchised Restaurant which we approve before or concurrently with the execution of the Franchise Agreement, the location will be identified in the Franchise Agreement.

What This Means (2025 FDD)
According to Checkers' 2025 Franchise Disclosure Document, if a franchisee suggests a location for their restaurant and Checkers approves it before or at the time of signing the Franchise Agreement, the location will be specifically identified within the Franchise Agreement itself. However, if an approved location is not agreed upon before signing the Franchise Agreement, the franchisee is then responsible for selecting a site within a designated geographic area.
Within 180 days of signing the Franchise Agreement, the franchisee must propose a site within the designated area for Checkers' approval. Checkers will then evaluate the proposed site based on criteria such as demographic characteristics, traffic patterns, parking availability, neighborhood character, competition, and the physical and commercial attributes of the site.
If Checkers approves a site after the Franchise Agreement is signed, the address of the approved location will be added to Exhibit B of the Franchise Agreement, officially designating it as the Premises. The franchisee is then required to provide a copy of the fully executed lease, sublease, or purchase contract, along with a franchise addendum to the lease agreement, within 60 days of the site approval. This process ensures that both parties are in agreement regarding the restaurant's location and that the franchisee takes the necessary steps to secure the site.
