What This Means (2025 FDD)
According to Checkers' 2025 Franchise Disclosure Document, if Checkers does not exercise its option to purchase the franchised restaurant after the franchise agreement terminates or expires without renewal, the franchisee is required to take specific actions to de-identify the premises.
Specifically, the franchisee must promptly remove all signs, fixtures, furniture, decor items, advertising materials, forms, and other materials and supplies that display any of Checkers' marks or distinctive features associated with Checkers restaurants. This includes discontinuing the use of these items for any purpose.
Furthermore, the franchisee is responsible for making necessary alterations to the premises, at their own expense, as required by Checkers. These alterations should clearly distinguish the location from its former appearance as a Checkers restaurant and from other Checkers restaurants, preventing any potential confusion among the public. If the franchisee fails to adequately de-identify the premises to Checkers' specifications, they will be required to reimburse Checkers for any losses and expenses incurred by Checkers in performing these actions on the franchisee's behalf.
