What must a Checkers franchisee conspicuously identify themselves as in all dealings with customers and others?
Checkers Franchise · 2025 FDDAnswer from 2025 FDD Document
Nothing contained in this Agreement, or arising from the conduct of the parties hereunder, is intended to make either party a general or special agent, joint venturer, partner or employee of the other for any purpose whatsoever. You must conspicuously identify yourself in all dealings with customers, lessors, contractors, suppliers, public officials, personnel and others as the owner of development rights granted hereunder and must place such other notices of independent ownership on such forms, business cards, stationery, advertising and other materials as we require at any time and from time to time.

What This Means (2025 FDD)
According to Checkers' 2025 Franchise Disclosure Document, a franchisee must conspicuously identify themselves as the owner of the development rights granted under the franchise agreement in all dealings with customers, lessors, contractors, suppliers, public officials, personnel, and others. This means that in every interaction with these parties, the franchisee must make it clear that they are the owner of the development rights for the Checkers franchise.
Furthermore, the franchisee is required to place notices of independent ownership on forms, business cards, stationery, advertising, and other materials as required by Checkers at any time. This ensures that all parties are aware that the franchisee is an independent owner and operator of the Checkers development rights, and not an employee or agent of Checkers itself.
This requirement is typical in franchising, as it helps to clarify the relationship between the franchisor and franchisee, and to avoid any confusion about who is responsible for the day-to-day operations of the business. It also protects Checkers from potential liability for the actions of its franchisees, as it makes it clear that the franchisees are independent business owners.
