What This Means (2025 FDD)

According to Checkers' 2025 Franchise Disclosure Document, the 'Effective Date' in the Development Agreement is the date signed by the franchisor, Checkers Drive-In Restaurants, Inc., as indicated on the agreement. The document specifies that this date is set forth opposite the franchisor's signature. This date marks the commencement of the agreement between Checkers and the area franchisee.

The 'Effective Date' is a critical element as it triggers several obligations and timelines for both the franchisor and the franchisee. For instance, the term of the Development Agreement begins on this date, as noted in Section 2.01. Furthermore, the franchisee typically has a limited time frame, such as ten days following the 'Effective Date', to fulfill certain requirements like procuring non-disclosure and non-competition agreements from relevant parties, as detailed in Section 6.03.

Additionally, the FDD provides specific 'Effective Dates' for Checkers franchises in certain states. For example, in Indiana, the 'Effective Date' is listed as April 7, 2025, and in Michigan, it is April 3, 2025. In Wisconsin, the effective date is also April 7, 2025. These dates may be relevant for compliance with state-specific franchise regulations and disclosures.

Prospective franchisees should pay close attention to the 'Effective Date' on their Development Agreement, as it serves as the starting point for their contractual obligations and the overall timeline for developing Checkers restaurants in their designated area. It is also important to note that the 'Effective Date' for Rally's franchises may differ from Checkers, even within the same state.
