How does the training provided by Chatime (Item 11) address the franchisee's obligations to maintain the safety and cleanliness of their store (Item 8)?

Chatime Franchise · 2025 FDD

Answer from 2025 FDD Document

The Initial Training Program is designed to address all phases of the operation of a franchise business and your Chatime Store. The Initial Training Program involves approximately two weeks of instruction for up to a maximum of four persons trained together at the same time. We will provide additional Initial Training Programs for any additional personnel at your cost. (Article 3 of the Franchise Agreement).

We will provide an electronic copy of our Operations Manual for your franchise business and your Chatime Store. Each Operations Manual contains mandatory and suggested standards, operating procedures and rules that we prescribe for the System. The Operations Manual is confidential, copyrighted, and not to be reproduced or distributed to any unauthorized person. We may change the Operations Manual at any time in our discretion. Our current Operations Manual consists of 397 pages. The sections and number of pages in each section are detailed in Exhibit H. (Clause 3.4 of the Franchise Agreement).

You will ensure that the day-to-day operation of the Franchised Business is always actively managed by an Operating Manager who has attended and successfully completed such training as we may require from time to time.

The Operating Manager will actively devote his or her full time, attention and effort to the Franchised Business and provide direct, day to-day supervision of the operation of the Franchised Business as provided in the then-current Operations Manual.

What This Means (2025 FDD)

According to Chatime's 2025 Franchise Disclosure Document, the initial training program is designed to address all phases of operating a franchise business and a Chatime store. This mandatory program requires franchisees, their general managers, and key management personnel to complete it to Chatime's satisfaction. The initial training involves approximately two weeks of instruction for up to four people at a time. The training is conducted at designated company-owned locations in Southern California, approved training locations, Chatime stores, or the franchisee's own Chatime location and is led by the Director of Operations.

While the FDD states that the Initial Training Program is designed to address all phases of the operation of a franchise business and your Chatime Store, it does not specifically detail how the training covers the franchisee's obligations to maintain the safety and cleanliness of their store. The FDD mentions that the Operations Manual contains mandatory and suggested standards, operating procedures and rules that Chatime prescribes for the System. The operating manager is also required to actively manage the day-to-day operations of the Chatime store as provided in the then-current Operations Manual.

To understand how Chatime's training program addresses safety and cleanliness obligations, a prospective franchisee should review Exhibit H, which details the sections and number of pages in each section of the Operations Manual. They should also ask the franchisor for a detailed breakdown of the training curriculum and its specific components related to safety, sanitation, and store maintenance. This will help them assess whether the training adequately prepares them to meet their obligations under the Franchise Agreement and Operations Manual.
