What This Means (2025 FDD)
According to Chatime's 2025 Franchise Disclosure Document, your right to use copyrighted materials is limited to the duration of your franchise agreement. Chatime retains ownership of all copyrights related to its operations manual, advertising, product content, and other materials. As a franchisee, you are granted permission to use these materials only while you remain a franchisee and in accordance with the terms outlined in the Franchise Agreement.
This means that once your franchise agreement expires or is terminated, you must cease using all copyrighted materials associated with the Chatime brand. This includes the operations manual, marketing materials, and any other proprietary information provided to you by Chatime. You cannot use these materials for your own benefit or disclose them to others outside of your role as a franchisee.
Chatime, along with La Kaffa, maintains control over any legal proceedings related to its copyrights. If legal action is necessary, Chatime will cover the costs you incur, provided they have authorized your actions. You are obligated to comply with Chatime's instructions regarding the use of copyrighted materials, including any requirements to modify or discontinue their use. This ensures that Chatime maintains consistent brand standards and protects its intellectual property.
This is a standard practice in franchising, as franchisors need to protect their brand identity and ensure consistent operations across all franchise locations. Prospective franchisees should carefully review the terms of the franchise agreement to fully understand the restrictions on the use of copyrighted materials and other intellectual property.
