What This Means (2025 FDD)
According to Chatime's 2025 Franchise Disclosure Document, the Developer acknowledges that they have not relied on any warranty or guarantee from Chatime regarding the potential financial performance of the business venture. Chatime expressly disclaims making any guarantees about the potential volume, profits, or success of the business. This indicates that Chatime does not provide financial projections or assurances to potential developers.
This acknowledgement is significant for prospective Chatime developers because it emphasizes that the success of the business is largely dependent on their own business abilities and independent investigation of the business opportunity. Developers are expected to conduct their own due diligence and not rely on any financial representations made by Chatime. This is a common practice in franchising, as franchisors often avoid providing specific financial projections to prevent potential legal issues.
The Developer and Guarantor also represent that all financial information provided to Chatime during the application process is complete, true, and correct. This places the onus on the developer to provide accurate financial information to Chatime. Chatime, in turn, relies on the developer's character, skills, and financial capacity when granting the development business. This mutual reliance underscores the importance of transparency and accuracy in the franchise application process.
Prospective Chatime developers should be aware of this disclaimer and conduct thorough independent research, including market analysis and financial forecasting, before investing in a franchise. They should also consult with financial and legal advisors to assess the risks and potential rewards of the Chatime franchise opportunity.
