- C. Franchisor identifies CD Stores by means of certain trade names, service marks, trademarks, logos, emblems and indicia of origin ("marks") as are now or may hereinafter be designated by Franchisor. The marks to be utilized in connection with the concept to be licensed to Franchisee pursuant to this Agreement, including "CD One Price Cleaners®," as Franchisor may add to, amend and replace them from time to time, are hereinafter referred to as "Proprietary Marks."

According to the 2025 FDD, Cd One Price Cleaners identifies its stores using trade names, service marks, trademarks, logos, emblems, and indicia of origin, which are collectively referred to as "marks". The specific mark mentioned in the FDD is "CD One Price Cleaners®." Cd One Price Cleaners retains the right to add to, amend, and replace these Proprietary Marks over time.
Cd One Price Cleaners franchisees are permitted to use only the Proprietary Marks designated by the franchisor and solely in the manner authorized. This use is restricted to the operation and advertising of the store at its designated site. Unless otherwise directed, franchisees must operate and advertise exclusively under the Proprietary Marks authorized by Cd One Price Cleaners. Franchisees must also identify themselves as independent owners in conjunction with any use of the Proprietary Marks.
Franchisees cannot use the Proprietary Marks to incur obligations on behalf of Cd One Price Cleaners and must notify the franchisor of any unauthorized use or challenges to the marks. Cd One Price Cleaners has the sole right to determine whether to take action regarding such infringements. Franchisees also agree not to contest the validity or ownership of the Proprietary Marks and acknowledge that their use of the marks does not grant them any ownership interest. All goodwill arising from the use of the Proprietary Marks benefits Cd One Price Cleaners and its affiliates exclusively.
Cd One Price Cleaners reserves the right to modify the marks used to identify the stores, and franchisees are obligated to implement any such changes at their own expense. Franchisees are also prohibited from using the Proprietary Marks as part of their corporate name, domain name, or in any way connected to a website. Upon termination or expiration of the franchise agreement, all rights to use the Proprietary Marks immediately revert to Cd One Price Cleaners, and the franchisee must cease all operations under those marks.
