You must also promise in writing that, among other things, during the term of the Franchise Agreement you will not participate in any business that in any way competes with a Casiola Business, and that for 24 months after the expiration or termination of the Franchise Agreement with said period being tolled during any periods of non-compliance, you will not participate in any competitive business located within and/or servicing customers located within your Operating Market and a 25 mile radius surrounding your Operating Market. What This Means (2024 FDD)

According to Casiola's 2024 Franchise Disclosure Document, as a franchisee, you must promise in writing that during the term of the Franchise Agreement, you will not participate in any business that competes with a Casiola Business. This restriction ensures that franchisees are fully committed to the success of their Casiola franchise and do not divert resources or expertise to competing ventures.

This non-compete agreement extends beyond the term of the franchise. For 24 months after the expiration or termination of the Franchise Agreement, with said period being tolled during any periods of non-compliance, you are prohibited from participating in any competitive business located within and/or servicing customers located within your Operating Market and a 25-mile radius surrounding your Operating Market. This clause protects Casiola's market share and customer base even after a franchise relationship ends.

In addition to the franchisee's non-compete obligations, any managers hired by the franchisee must also sign confidentiality and non-competition agreements. This requirement ensures that individuals with access to Casiola's confidential information and operational strategies are legally bound to protect the brand's interests. This is a common practice in franchising to maintain brand consistency and prevent the dissemination of proprietary information to competitors.
