What This Means (2024 FDD)
According to Casiola's 2024 Franchise Disclosure Document, the Washington FDD Amendment addresses the issue of conflicting laws. Specifically, the amendment states that if there is a conflict of laws, the provisions of the Washington Franchise Investment Protection Act, Chapter 19.100 RCW, will take precedence. This means that the terms and conditions outlined in the Washington Franchise Investment Protection Act will supersede any conflicting terms in the Casiola franchise agreement or other related documents.
Additionally, RCW 19.100.180 may also supersede the franchise agreement, particularly in areas concerning termination and renewal of the franchise. The amendment also acknowledges that court decisions could potentially override the franchise agreement in matters such as termination and renewal.
This amendment is important for prospective Casiola franchisees in Washington because it clarifies that certain protections and rights under Washington law cannot be waived or superseded by the standard franchise agreement. Franchisees should be aware of these protections and consult with legal counsel to understand their rights under Washington law.
