What This Means (2024 FDD)

According to Casiola's 2024 Franchise Disclosure Document, a franchisee must obtain Casiola's prior written consent to relocate their Administrative Office to a suitable commercial facility within their Operating Market. Casiola will not unreasonably withhold this consent if the franchisee is in compliance with the terms and conditions of the Franchise Agreement and the new facility meets Casiola's then-current standards and specifications.

This means that Casiola retains the right to ensure that any relocation of the Administrative Office meets certain criteria. These criteria include the franchisee's compliance with the franchise agreement and the suitability of the new facility according to Casiola's standards. If a franchisee is not meeting their obligations under the agreement, or if the proposed new location does not align with Casiola's requirements, Casiola can withhold its consent.

This provision protects Casiola's brand and operational standards by ensuring that all administrative offices meet a consistent level of quality and adhere to the franchise agreement. For a prospective franchisee, it highlights the importance of maintaining compliance with the franchise agreement and understanding Casiola's standards for administrative offices. It also means that franchisees cannot move their administrative office without approval, even within their operating market.
