What This Means (2024 FDD)

According to Casiola's 2024 Franchise Disclosure Document, the standard cure period for a franchisee to address a default is up to 30 days after receiving written notice. However, this timeframe is specifically referenced within the Michigan FDD Amendment, indicating its applicability may be limited to franchises operating within Michigan.

It is important to note that Casiola can terminate the franchise agreement without providing an opportunity to cure under certain circumstances. These circumstances include instances where the franchisee repeatedly defaults under specific articles of the agreement, or intentionally breaches the agreement in a way that harms Casiola or its system.

Prospective Casiola franchisees should be aware of the specific conditions under which they are entitled to a cure period and the actions that could lead to immediate termination. Franchisees should consult with a legal professional to fully understand their rights and obligations under the franchise agreement, particularly in relation to default and termination clauses, and how state-specific amendments may impact those terms.
