What This Means (2024 FDD)
According to Casiola's 2024 Franchise Disclosure Document, Casiola has specific rights regarding a franchisee's Administrative Office, including the right to enter the premises to make alterations if the franchise agreement is terminated. Casiola's standards and specifications must be met and approved by Casiola for the Administrative Office location.
Specifically, if a franchisee's agreement is terminated, Casiola can require the franchisee to modify their former Casiola Business and Administrative Office to differentiate it from its former appearance. This is to prevent public confusion about the continued existence of a Casiola Business at that location. Franchisees must remove all distinctive physical and structural features, signs, trade dress, and emblems associated with the Casiola system.
Casiola can request additional changes to the Administrative Office to completely de-identify the former Casiola Business. If the franchisee fails to make these modifications in a timely manner, Casiola or its agents can enter the premises to make the alterations at the franchisee's expense. The franchisee consents to an ex-parte court order authorizing Casiola to take action if necessary. This ensures that Casiola can protect its brand and prevent confusion after a franchise agreement ends.
