What This Means (2024 FDD)

According to Casiola's 2024 Franchise Disclosure Document, the franchisor, not the franchisee, owns all 'Bookings and Management System Data.' This data includes forms, customer information, and sales information that is pre-populated, entered, recorded, stored, or maintained within the Bookings and Management System.

This means that while a Casiola franchisee operates the system and inputs data related to their specific franchise, the ownership of that data ultimately resides with Casiola. Casiola also has direct access to this data. This arrangement allows Casiola to monitor performance, maintain consistency across the brand, and leverage the collective data for strategic decision-making.

For a prospective franchisee, this clause highlights the importance of understanding data ownership and usage rights. While franchisees contribute to the data, they do not own it and must maintain and preserve it for transfer to Casiola upon termination or expiration of the franchise agreement. Franchisees must also adhere to all applicable privacy and data collection laws while storing and maintaining this data.
