What This Means (2024 FDD)
According to the 2024 Casiola Franchise Disclosure Document, "Advertising Contributions" encompass all financial obligations a franchisee has to Casiola or its affiliates for advertising purposes. These obligations include Brand Development Fund Fees, as detailed in Article 9.A of the agreement, and contributions to any Advertising Cooperative, as outlined in Article 9.C.
If Casiola establishes an Advertising Cooperative that includes the franchisee's operating market or business location, the franchisee must participate and contribute financially to it. The Advertising Cooperative determines the contribution amounts, but they cannot exceed the franchisee's local minimum marketing obligations as specified in Article 9.B. Contributions to the Advertising Cooperative count toward fulfilling these minimum local marketing obligations. The cooperative is intended to administer marketing programs and develop media for local or regional marketing, subject to Casiola's review and approval.
Franchisees should note that Casiola has the right to designate geographic areas for Advertising Cooperatives and that participation is mandatory if the franchisee's business is located within such an area. Casiola also retains the right to use the franchisee's name, address, photograph, and biographical information in publications related to the Casiola system, including those related to franchise sales. Additionally, Casiola can use the franchisee's financial data for reporting purposes in its Franchise Disclosure Document.
