What This Means (2024 FDD)

According to Casiola's 2024 Franchise Disclosure Document, the Michigan FDD Amendment states that the state of Michigan prohibits certain unfair provisions that are sometimes found in franchise documents. If any of these provisions are in Casiola's franchise documents, they are void and cannot be enforced against the franchisee. One such prohibited provision is "A prohibition of your right to join an association of franchisees."

This means that Casiola cannot legally prevent a franchisee in Michigan from joining an association of franchisees. Any clause in the franchise agreement that attempts to do so is unenforceable under Michigan law.

For a prospective Casiola franchisee in Michigan, this is a beneficial protection. It ensures the franchisee can freely associate with other franchisees to share information, negotiate collectively, and advocate for their interests without fear of reprisal from Casiola.
